
There has been a legal battle with a pub and it’s owner, Karen Murphy over the showing of football in her pub. Specifically 3PM Saturday kick-offs via foreign tv packages, as you are not allowed to show 3pM kick-offs in the UK. It has been an agreement with the TV people and the Premier League for a long time, but if you are watching football abroad, i.e. via a foreign provider they are allowed and do show Premier League 3PM kick-offs; You will know this if you ever go on holiday you can watch games.
She has won her latest battle, and the European Court of Justice has ruled in her favor.
The ECJ now says national laws which prohibit the import, sale or use of foreign decoder cards are contrary to the freedom to provide services.
It said national legislation, which banned the use of overseas decoders, could not “be justified either in light of the objective of protecting intellectual property rights or by the objective of encouraging the public to attend football stadiums”. – BBC
The ECJ findings will now go to the High Court in London, which had sent the matter to the ECJ for guidance, for a final ruling.
Why the current situation is unfair to the consumers in the European Union
EXAMPLE – So you want to watch something on German pay TV, and you want to do it legally and pay SKY Deutschland for a subscription. They will not sell you a subscription direct. They will tell you they “don’t have the rights” to broadcast in your country; You will need a local address (in Germany) and other forms of identification too. It is the same for all the providers in Europe, you cannot go direct to them, as they will not sell you a legal subscription you should be legally allowed to buy under EU law.
EXAMPLE 2 – So you are Spanish, and come to England to work and live. You decide you wanna still watch your favourite Spanish TV shows, so you call them to subscribe, but you wont be able to, because they will not let you without a Spanish address to register the subscription to.
EXAMPLE 3 – (It works both ways) You are English and go over to Spain to live, you call up SKY UK to get a subscription and they will not sell you one, you are in Spain, you are not allowed to watch SKY.
Under the current rules, policies and Terms of Service (not law) you are not allowed to subscribe to foreign providers, some 3rd parties offer services but over charge MASSIVELY! You can get subscriptions from 3rd parties for something like €1000-€2000/year depending on the provider which is a disgrace, instead of paying the provider direct like a local person would.
We are one European Union, if I want to buy a t-shirt from Spain I can, so why cant I pay for and watch Spanish TV?! Or German, or any other I want! It is terrible that a person who is abroad can watch more UK Premiership football than a person living in the UK.
Why dont they just let everyone subscribe to what they want? SKY would make a fortune anyway, many of the providers in Europe carry the “SKY” branding, so selling SKY Italia to the UK and SKY UK to Italy wouldn’t be that big of a deal, in fact they’d probably make even more money!
It is exactly the same online, try going to MTV.com and watching some videos outside of the U.S. it will not happen; Then try on MTV.co.uk to watch the SAME video and it will work! The media industry really need to change it’s ways, they complain all day long about piracy and people not doing things legally, but when people try they hit them up with red tape, rules and regulation and such, or make it near impossible for people to get a product or service they actually want.
